Owners’ Club terms and conditions

INTRODUCTION

We aim to provide you with great service and great experiences. Our intention is to consistently exceed your expectations, and give you confidence to continue your membership with us.

These terms and conditions (“Terms”) together with other information brought to your attention via our registration form, forms the basis of your contract with us and applies to all services and all contact made with Boat International Media Limited (BIM), a limited company registered in England with company number 2650007 and having its registered office address at 41-47 Hartfield Rd, Wimbledon, London SW19 3RQ, UK (“BIM”, “we”, “us” and “our”). In these Terms, “you” and “your” means the person who is completing the registration form, and by completing this registration form you are confirming that you are at least 18 years old at the time of registration form completion, or where required in some countries, for example USA, at least 21 at the time of completing this registration form. And by completing this form you are confirming that you have owned, currently own or are in the process of purchasing a sailing or motor yacht at 24 metres long or above. All correspondence and other communications will be sent to the address of the person completing this registration, unless you specify otherwise. If you request correspondence to be sent to a business address, a residential address will also be required for emergency and security reasons.

Please read the following Terms carefully. They set out the respective rights and obligations and all membership registrations are accepted by BIM subject to these booking Terms; they form the basis of your contract with BIM and you are deemed to have agreed to and accepted these Terms when you submit your membership registration to us.

We constantly review the information on our Website, brochures, other marketing materials and proposals to try to keep them accurate and up to date to the best of our knowledge. However, please note this information is provided for guidance only and may change or may contain an error; we are not liable for anything that is incorrect.

1. MEMBERSHIP

1.1 Duration: When you join the Owners’ Club you are agreeing to remain a member until you contact BIM by either post or email notifying us of you wish to level the Owners’ Club. To contact BIM by post, please send to: Owners’ Club, 1st Floor, 41–47 Hartfield Road, London SW19 3RQ, UK, and to contact us by email, please send to ownersclub@boatinternationalmedia.com.

1.1.2 BIM may, without prior notice or explanation, withdraw your membership to the Owners’ Club, and in such instance you will be notified via email.

1.2 Fees: There is no joining fee or minimum term for membership to the Owner’s Club.

1.3 Joint Membership: Joint membership is restricted to Primary member’s spouse/partner, and the additional member will be subject to these terms and conditions.

1.4 Transfer of membership is not permitted, and in the instance that you no longer wish to remain a member of the Owners’ Club, please notify BIM by post at Owners’ Club, 1st Floor, 41–47 Hartfield Road, London SW19 3RQ, UK, or by email at ownersclub@boatinternationalmedia.com.

1.5 Gifting: As part of your Owners’ Club membership, you are also entitled to receive a free subscription to the Boat International or US Boat International Magazine. This subscription is valid for the duration of your subscription to the Owners’ Club, and if, at any point, you withdraw your membership the magazine subscription will also end. Free subscription to Boat International or US Boat International magazines is at the sole discretion of BIM, and may be cancelled or withdrawn at any time without prior notice. If you would like to cancel your magazine subscription at any time please notify us by post at Owners’ Club, 1st Floor, 41–47 Hartfield Road, London SW19 3RQ, UK, or by email at ownersclub@boatinternationalmedia.com.

1.5.1 You may also, from time to time, receive complimentary gifts from BIM, which will be sent to the postal address listed on your registration form. If you would like to opt out from these complimentary gifts, please let us know by post at Owners’ Club, 1st Floor, 41–47 Hartfield Road, London SW19 3RQ, UK, or by email at ownersclub@boatinternationalmedia.com.

1.6 Owners’ Club members will also receive invites to exclusive Owners’ Club events, arranged and hosted by BIM, but to receive invites to these events, you must have selected to be contacted by BIM by post, email or telephone. Without your consent to be contact, BIM will be unable to send invitations and details on how to register for these events. To check or change your marketing permissions at any stage please contact us by email at ownersclub@boatinternationalmedia.com.

2. SPONSORSHIP

2.1 The Owners’ Club title sponsor, who may, from time to time, attend exclusive Owners’ Club events.

2.2 Organisations, as selected by BIM, may also become sponsor of the Owners’ Club, and may, from time to time, attend exclusive Owners’ Club events.

3. PRIVACY

3.1 BIM respects your right to privacy, and will never share your information to any third parties, other than those who need this information in the course of providing services to you and honouring our contractual obligations to you, as a member of the Owners’ Club.

This Privacy section explains how we collect, share and use personal information about you.

3.2 Personal data we collect: BIM collects data to effectively operate the Owners’ Club and provide you with the best experience from our products and services. Some of this data will have been provided directly by you, such as when you complete the Owners’ Club registration form, register to attend an Owners’ Club event, provide details to subscribe to one of our products or contact us for support. We’ll also get some of the data by recording how you interact with our products and services, for example, using technologies like cookies which are explained in more detail in our complete Privacy Policy available to view at https://www.boatinternational.com/privacy-policy.

The data we collect at BIM depends on the context of your interactions with us, the choices you make, including your privacy settings, and the products and features you use. The data we collect can include the following:

Name and contact details: We collect your first and last name, email address, postal address, phone number, company name, job title, and similar other contact data.

Demographic data: We collect data about you such as your date of birth and country.

Personal interests: We collect data about you such as your interests and hobbies, if you have chosen to provide us with such details.

This data is collected to enable us constantly improve our service and products, whilst ensuring that you are only sent the information that you want, and like to engage with. We also collect the information you agree to share with us, such as feedback and market research, or questions and information you provide for customer support. When you contact us, such as for customer support, phone conversations or chat sessions with our representatives may be monitored and recorded.

3.3 How we use your data: BIM uses the data we collect to operate the Owners’ Club and provide you with the products and services we offered as part of this, which includes using data to improve our products and services and personalise your experiences.

We may also use the data to communicate with you, for example, informing you about your membership, security updates and product or service information.

3.4 Communication: We use data we collect to communicate with you and personalise our communications with you. For example, we may contact you by phone or email to let you know that a subscription is coming to an end, notify you of changes to your membership, let you know about security updates or privacy updates, invite you to participate in a survey, provide you with important information relating to a purchase or subscription, or tell you that you need to take an action to activate your membership.

3.4.1 Marketing Communications: Additionally, you can sign up to email subscriptions and choose whether you would like to receive promotional and marketing communications from Boat International Media, by email, telephone or post. If you have given us permission to do so, we will use your personal details in order to notify you of other offers and promotions which might be of interest to you. If you change your mind at any time you can unsubscribe from our emails by clicking on the ‘unsubscribe’ link at the bottom of every email, or by contacting us directly at unsubscribe@boatinternationalmedia.com.

3.5 Legal basis for processing personal information: Our legal basis for collecting and using the personal information described above will depend on the personal information concerned and the specific context in which we collect it.

However, we will normally collect personal information from you only (i) where we need the personal information to perform a contract with you, (ii) where the processing is in our legitimate interests and not overridden by your rights, or (iii) where we have your consent to do so. In some cases, we may also have a legal obligation to collect personal information from you or may otherwise need the personal information to protect your vital interests or those of another person.

If we collect and use your personal information in reliance on our legitimate interests (or those of any third party), this interest will normally be to operate our platform and communicating with you as necessary to provide our services to you and for our legitimate commercial interest, for instance, when responding to your queries, improving our platform and undertaking marketing.

3.6 Storing personal data: BIM uses appropriate technical and organisational measures to protect the personal information that we collect and process about you. The measures we use are designed to provide a level of security appropriate to the risk of processing your personal information.

3.7 Sharing personal data: BIM may disclose your personal information to BIM vendors, with your consent or as necessary to complete any transaction or provide any product or information you have requested or authorised. Additionally, we may disclose your personal information to any competent law enforcement body, regulatory, government agency, court or other third party, when we believe disclosure is necessary to; Comply with the applicable law or regulation, To exercise, establish or defend our legal rights, or To protect your vital interests or those of any other person.

3.8 International Data Transfer: Your personal information may be transferred to, and processed in, countries other than the country in which you are resident. These countries may have data protection laws that are different to the laws of your country. We have taken appropriate safeguards to require that your personal information will remain protected in accordance with the BIM complete Privacy Notice.

3.9 Your Rights: As the data subject, you have the right to request (by letter or email) confirmation on what personal information is being held or processed, for what purpose and who these details may or will be disclosed to. In limited circumstances we are entitled to refuse your request if this is found to be manifestly unfounded or excessive, taking into account whether the request is repetitive in nature. You also have the right to access, correct, update or request deletion of your personal information, you can object to processing of your personal information, ask us to restrict processing of your personal information or request portability of your personal information, you can do so at any time by contacting us on ownersclub@boatinternationalmedia.com.

Similarly, if we have collected and process your personal information with your consent, then you can withdraw your consent at any time. Withdrawing your consent will not affect the lawfulness of any processing we conducted prior to your withdrawal, nor will it affect processing of your personal information conducted in reliance on lawful processing grounds other than consent. You also have the right to complain to a data protection authority about our collection and use of your personal information. 4. GOVERNING LAW

4.1 These Terms and any dispute or claim arising in connection with them or their subject matter or formation, or our services, shall be governed by, and construed in accordance with, the law of England and Wales. The parties irrevocably agree that the courts of England and Wales shall have exclusive jurisdiction in relation to all claims, disputes and other matters arising in connection with your contract, booking or relationship with us. We reserve the right to amend, add or withdraw any of our Terms at any time and without notice.
